What is hemp-derived at Delta 9 THC?

Delta 9 THC, or D9 THC as it’s also referred to, stands for Delta nine tetrahydrocannabinol and it is a psychotropic cannabinoid found in both the hemp and marijuana plants. D9 is just one of over 100 different cannabinoids that exist in the cannabis and hemp plants.

Delta 9 THC as a chemical compound…

Despite cannabis not being federally legal, it has just gone recreational in the state of Maryland. The Farm Bill of 2018 legalized hemp-derived products as long as they did not contain more than .3% Delta 9 THC on a dry weight basis. Most people do not realize that delta-nine THC from hemp is the same chemical compound as delta-nine THC found in cannabis. Being that hemp and cannabis share the same chemical makeup, they will create similar effects when consumed.

How is it legal?

The Farm Bill of 2018…

When the Farm Bill of 2018 was created, it opened up more access to the myriad of cannabinoids found in the plant. It also allowed .3% Delta nine THC on a dry weight basis to exist. This bill was written in terms of dry flower, but the legal language opened up other products like edibles to also contain these levels of THC and be a legal product. This means that on a dry weight basis, .3% of that product can contain delta nine THC as long as it is derived from the hemp plant and not the cannabis plant.

Why is this significant?

The key difference between legal hemp-derived Delta 9 THC and cannabis-derived Delta 9 THC is in the language around a dry weight basis in the current Farm Bill of 2018. The Farm Bill allows .3% of the weight of a gummy or brownie, for example, to be Delta 9 THC as long as it is sourced from the hemp plant. This is why you might be seeing hemp-derived Delta 9 THC products hit the market in such great quantities. In fact, Derived Creations is now offering these products in caramels and taffy products.
